On October 26, 2018, the Standing Committee of the National People’s Congress adopted a decision establishing a national intellectual property appellate court within the Supreme People’s Court, effective January 1, 2019.
Appeals from first-instance judgments or rulings in technically complex civil IP cases are to be heard by the Supreme People’s Court. These include invention and utility model patents, new plant varieties, integrated-circuit layout designs, technical secrets, computer software and antitrust cases.
The Supreme People’s Court likewise hears appeals in technically complex administrative IP cases involving patents, new plant varieties, integrated-circuit layout designs, technical secrets, computer software and antitrust.
Where effective judgments, rulings or mediation agreements in these categories are challenged through retrial or procuratorial protest under supervisory procedures, the Supreme People’s Court hears the matter. It may also designate a lower court to conduct the retrial in accordance with law.
