The State Intellectual Property Office(SIPO) established a collaborative center of patent law enforcement in ecommerce in Zhejiang province. Through establishing collaborations between provincial IP enforcement authorities and e-Commerce platforms in Zhejiang, the center will effectively resolve the pain spot of e-commerce patent infringements. This is the first collaborative center in China for e-commerce patent law enforcement.
It is understood that, after this Center duly started, the efficiency of e-commerce enforcement will be greatly enhanced:
①The Center can distribute the patent enforcement reports or complaints received from the Zhejiang eCommerce platform to nationwide local IP aid-centers for handling, and the corresponding aid-center will give its consulting opinions as soon as possible.
②Local IP offices shall provide assistance as quickly as possible after receiving the assistance request from the center, and the State Intellectual Property Office will coordinate to handle cases with significant social influence or group infringement.
③For patent infringement and counterfeiting verified online, the Center can confirm the details of the respondent through the e-Commerce platform, and transfer in a timely manner the clues of the cases to the competent local IP office for offline handling, thus combating the patent infringement actions from the source.
