In order to cooperate with the implementation of the “Stamp Tax Law of the People's Republic of China, the China National Intellectual Property Administration will stop the collection of stamp tax relating to patent certificates and registration certificates of layout-design of integrated circuits from July 1, 2022.
To better safeguard the rights of patentees, for stamp tax that is overpaid, mistakenly paid or double-paid within 3 years from the date of payment, the patentee shall submit a statement (about fee) for refund as soon as possible.
According to relevant processing procedure, the certificate of patent applications registered after June 15, 2022(inclusive) will be issued after July 1, 2022. Therefore, no stamp tax will be paid for patents registered after June 15, 2022 (inclusive).
