China Customs published the benefits of customs recordation of intellectual property rights in China. Specifically include the following.

(1) Customs Recordation is a prerequisite for the customs to take proactive actions According to the "Regulations of Customs Protection of Intellectual Property Rights", if an intellectual property right holder has filed an application to the customs to record his intellectual property rights in advance, the customs authorities have the right to stop the importation/exportation of suspected infringing goods, and perform investigation of the infringing goods when the rights holder applies for protection and provides a security.

(2) Customs Recordation helps the customs find infringing goods timely.

When applying for Customs Recordation, the intellectual property rights holder shall provide information regarding legal status of the intellectual property, information about the suspected infringing goods, and lawful usage of the intellectual property rights, which can help the customs to find suspected infringing goods during daily supervision procedures and take the initiative to detain the goods so that the legitimate rights of the rights holder can be protected in a timely manner.

(3) Customs Recordation can reduce the economic burden of right holders.

Under the of ex officio protection mode of the customs, the security provided by the intellectual property rights holder to the customs shall not exceed RMB 100,000. If the right holders failed to record the customs protection in advance, he can not enjoy the above treatment. He must provide a security of the equivalent value of the goods requested to be detained. Therefore, the proactive customs recordation can greatly reduce the cost to defend the holder’s right and reduce his economic burden.

(4) Customs Recordation can have a deterrent effect on the infringer.

The customs authorities have the right to confiscate imported/ exported infringing goods and impose administrative penalties on the infringers. Therefore the Customs Recordation of intellectual property rights as early as possible can have warning and deterrent effects on those enterprises that used to import and export infringing goods without scruples in the past, prompting them to consciously respect the relevant intellectual property rights. In addition, some enterprises that do not maliciously export infringing products may also obtain information about whether the goods they contracted to process and export may constitute infringement through checking the customs recordation records, so as to avoid economic losses caused by detention of goods by the customs.
