China’s State Council revised three sets of copyright regulations: the Implementing Regulations of the Copyright Law, the Regulations on the Protection of the Right of Communication through Information Networks, and the Regulations on Computer Software Protection. The amendments took effect on March 1, 2013.
Under the amended Implementing Regulations of the Copyright Law, where copyright infringement also harms the public interest and the illegal business turnover is RMB 50,000 or more, the copyright authority may impose a fine of between one and five times that turnover. Previously, the maximum was three times the turnover. The amendment also introduces a minimum fine of one times the turnover. Where there is no illegal business turnover, or it is below RMB 50,000, the maximum fine increases from RMB 100,000 to RMB 250,000.
Articles 18 and 19 of the Regulations on the Protection of the Right of Communication through Information Networks are amended in the same way, increasing the range of fines available to the copyright authority.
Under the amended Regulations on Computer Software Protection, the copyright authority may order infringement to cease, confiscate unlawful income, confiscate or destroy infringing copies, and impose a fine.
