Question:
If I failed to respond to an office action issued by SIPO within the specified time limit, is there any chance to file a response after the expiration of the time limit?
Answer:
If the applicant fails to respond to an office action in due time, the application shall be deemed to be withdrawn.
However, within 2 months from the date of receiving the notification that the application deemed to be withdrawn, if the applicant submits the observations (when an amendment to the claims is made, a replacement sheet shall also be submitted), as well as a request for restoration of right, and pays the fee for requesting restoration of right, the application can generally be restored.
