The amended Anti-Unfair Competition Law includes the following changes.
1) It clarifies confusing conduct. The key question is whether conduct misleads people into believing that goods belong to another party or have a particular connection with that party. Unauthorized use of another party’s identifiers is restricted where those identifiers have a certain influence.
2) It clarifies recipients of commercial bribes, including employees of the counterparty, entities or individuals entrusted by that counterparty to handle relevant matters, and entities or individuals using power or influence to affect a transaction.
3) It prohibits false promotion, including fabricated sales figures and consumer reviews.
4) It strengthens protection of trade secrets. A third party that knows or should know that an employee, former employee or another entity or individual has acted unlawfully, but nevertheless acquires, discloses, uses or permits others to use the trade secret, is deemed to infringe it.
5) It further prohibits unfair online competition, including misleading, deceiving or forcing users to alter, close or uninstall an online product or service lawfully provided by another business.
