If an applicant, within six months from the date of the first application/first exhibition, files a trademark registration application in China for the same goods with the same trademark, the applicant may claim priority. The claim for priority shall be declared in the trademark registration application. If not declared, it shall be deemed that no priority is claimed. If the priority period is exceeded, an application for restoration is not allowed.

The certified priority documents may be submitted simultaneously with the new application, or may be supplemented within three months from the filing date, and this time limit cannot be extended any further. If the priority documents are in a foreign language, a Chinese translation shall be provided at the same time. If the priority documents are not submitted within the time limit, it shall be deemed that no priority is claimed.
